Landlord-tenant law is very technical and fraught with traps for the unwary.  This firm can help you evict your tenants in Central Florida.

To file an eviction action for non-payment of rent, you will first have to serve a notice on the tenant.  Then you file the eviction action in county court.  The typical court filing fee is $185.00.  There is a summons fee of $10.00 for each adult tenant and a process service fee payable to the sheriff's office in the amount of $40.00 per adult tenant.  After the court has entered an order granting possession of the property, the clerk's office issues a Writ of Possession.  There is an additional charge of $90.00 payable to the county sheriff's office for them to serve the Writ of Possession.  After they have delivered the writ, the tenant generally has 24 hours to move out.  Typically, you will incur an expense of $235.00 to sue one tenant for eviction and $285.00 to sue two tenants.

My office charges a flat attorney's fee of $450.00 to draft and file the necessary documents for a simple uncontested residential eviction.  This results in a total cost in a single tenant simple uncontested eviction of $685.00.  If the landlord needs the eviction filed immediately, call the office to determine if it is possible to do so and there will generally be an additional fee of $100.00 for the rush service.

Most Landlords are concerned about the expense, as they should, but please do not place the bottom line on an eviction ahead of the overall cost you may incur if the attorney you select does not do the job properly.  How many months of rent will you lose?  How much could you end up paying in attorney's fees for the tenant?  Yes, the landlord could be responsible for the tenant's attorney's fees.  Self Help is not allowed in Florida.  It is improper for a landlord to change the locks to the property, shut off utilities and a number of other self-help actions are prohibited.  In some cases the tenant may be entitled to three months rent as a result of the landlord's improper actions.  Generally, if the tenant is successful in stopping the eviction the landlord will have to pay the tenant's attorneys' fees.
